Terms of Service

Welcome to Caminho.DEV. These Terms of Service ("Terms") govern your use of our website and services. By accessing our website or engaging our services, you agree to be bound by these Terms.

Caminho.DEV is run by two sister businesses. Which one you deal with depends only on where you are based:

• In the European Union (Portugal included): CaminhoIT, Lda., a company registered in Portugal. It contracts with you, invoices you and keeps its accounts under Portuguese law.
• In the United Kingdom, or anywhere else outside the European Union: CaminhoIT, our UK business. It contracts with you, invoices you and keeps its accounts under UK law. CaminhoIT, Lda. is not a party to your agreement.

"Where you are based" means the billing country you give us. The business you deal with is named on your proposal, your order and your invoices.

Caminho.DEV provides web development, design, and digital services. This includes but is not limited to:

• Website design and development
• Web application development
• E-commerce solutions
• UI/UX design
• Website maintenance and support
• Hosting services (via PassoCloud)

Specific project work is governed by individual proposals and contracts that outline scope, deliverables, timeline, and payment terms. In case of conflict between these general Terms and a specific project agreement, the project agreement shall prevail.

Proposals

Proposals provided by Caminho.DEV are valid for the period specified in the proposal (typically 30 days unless stated otherwise). Proposals become binding agreements once signed by both parties.

Payment Terms

Payment terms are specified in individual project agreements. Unless otherwise agreed:

• A deposit is required before work commences
• Milestone payments may be required for larger projects
• Final payment is due upon project completion before final deliverables are transferred
• Late payments may incur additional fees as specified in the agreement

Our Property

The Caminho.DEV website, brand, logo, and all content therein remain our intellectual property. Any tools, frameworks, or reusable components we develop as part of our internal processes remain our property unless explicitly transferred in a project agreement.

Client Projects

Upon full payment, clients receive ownership of custom work created specifically for their project, where that transfer is expressly agreed in the applicable quotation or project agreement. These transfer provisions apply only to one-off commissioned development. They do not apply to Caminho.DEV Website Plans, which are subscription services governed by the separate Website Plan Terms — a Website Plan does not transfer ownership of the website, its source code or its platform components.

When using our website, you agree not to:

• Use the website for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Transmit malicious code or interfere with website functionality
• Collect information about other users without consent
• Reproduce, duplicate, or copy our website content without permission

To the maximum extent permitted by law, the Caminho.DEV business you deal with (see section 1) shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our website or services.

Our total liability for any claim arising from our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

Our website is provided "as is" without warranties of any kind. While we strive to keep information accurate and up-to-date, we make no guarantees about completeness, accuracy, or reliability of any content.

Project work is delivered according to the specifications in individual agreements, with warranties as specified therein.

Which law applies depends on which business you deal with (see section 1). If you are in the European Union, these Terms and any agreement with CaminhoIT, Lda. are governed by the laws of Portugal, and the Portuguese courts have jurisdiction. If you are in the United Kingdom or anywhere else outside the European Union, these Terms and any agreement with CaminhoIT are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer, nothing in this section takes away the mandatory consumer protections of the country you live in, or your right to bring proceedings in your local courts where that law allows it.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our website after changes constitutes acceptance of the modified Terms.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
